BACKGROUND

In March 2018, Gaston County acquired Parcel 203783 located at 2005 Beauhaven Lane, Belmont via public sale at the Gaston County Courthouse.  The parcel is located within the Reflection Pointe subdivision and is subject to Homeowners Association dues.  At the time of acquisition, a delinquent balance of $1,490.15 in HOA dues was transferred to the new owner, Gaston County.  On January 1, 2019 a payment was made to the Homeowners Association in the amount of $905.09.  In addition to the outstanding balance, additional HOA dues as well as late payment fees have been assessed to the parcel.  On February 28, 2019 Gaston County received written notification from the law firm representing Reflection Point Homeowners Association, Inc. of a lien that has been placed on the parcel for the delinquent and past due account .  The HOA Board has approved a waiver of attorney fees and the current balance due is $1,412.66, good through March 31, 2019.

Approval of this Board Action authorizes a fund balance appropriation in the amount of $3,225.00 to satisfy all sums due to the Homeowners Association as described in the Claim of Lien ($1,412.66) as well as Homeowners Association dues for calendar year 2019 to be paid in the amount of $1,812.00.  Additionally, approval of this Board Action authorizes staff to process payment to the Homeowners Association, satisfying sums due as described in the Claim of Lien, and deliver payment to the firm of Rogers Townsend & Thomas P.C. no later than March 31, 2019.
