BACKGROUND

On February 23, 2021, the Gaston County Board of Commissioners approved Board Action 2021-060 to accept an offer in the amount of $5000 to purchase a County owned surplus (PID #100036) located at 1608 North Weldon St. and initiate the upset bid process.

The Public Works office has received an upset bid offer from Mr. Brian Litwak to purchase said property for $6,200. Approval of this Board Action formally accepts said offer and authorizes staff to proceed with the upset bid process.

Gaston County currently owns PID 100036 (.33 acres) located at 1608 North Weldon St., Gastonia. On February 24, 2011 the Gaston County Board of Commissioners approved a Board Action (2011-052) to declare this non-essential County-owned property as surplus and authorized staff to initiate sale procedures pursuant to applicable North Carolina General Statute. This parcel is not in an area the County is planning to redevelop, nor is it planned for current or future development for County use.

Under G.S. 160A-269, a County has the authority to “receive, solicit, or negotiate an offer to purchase property and advertise it for upset bids.” Under this statute, if the Board of Commissioners accept an offer for said property, the County must then advertise the bid in the newspaper and allow ten (10) days for other bids to be received. Staff will bring the highest and best offer back to the Commission for final approval.
