BACKGROUND
The American's with Disabilities Act (ADA) prohibits discrimination against people with disabilities. In 2010, the Department of Justice revised the Title II and Title III Acts and issued the 2010 ADA Standards for Accessibility Design. Under the revised Title II Act, state and local governments, public entities or agencies, must provide access for people with disabilities to every service and program they offer. Gaston County staff developed a Request for Qualifications (FRQ) document and publicly advertised on December 8, 2015 for interested firms to review and update our 1994 ADA Transition Plan for compliance with ADA. The 1994 plan is outdated from a facility standpoint and does not fully address park locations and/or internal programs and services. Three firms submitted Statements of Qualifications by the January 8, 2016 deadline. Those firms include Tindale Oliver, Accessibility Consultants, Inc, and Disability Rights and Resources. A panel of staff including the County's ADA coordinator individually evaluated and ranked each submittal relative to content and qualifications of each company to perform the work. Upon completion of the review, the panel recommended Tindale Oliver as the firm to complete the transition plan update. Approval of this Board Action and attached Budget Change Request formally selects Tindale Oliver to conduct the field surveys and prepare the transition plan update and authorizes funds to allow our local disability advocate, Disability Rights & Resources, to provide staff ADA training.
