BACKGROUND

The NC Sedimentation Control Commission (SCC) has approved an updated Memorandum of Agreement (MOA) between the Local Governments with delegated Soil Erosion and Sedimentation Control Programs and the Commission. This MOA outlines the responsibilities of both the Commission and delegated program. The Commission is formally requesting that the Local Governments renew agreements with the Commission and sign this updated version of the MOA.

This MOA outlines the responsibilities of both the Commission and the delegated Soil Erosion and Sedimentation Control Program operated by Gaston County’s Natural Resources Department.

The MOA between Gaston County and the NC Sedimentation Control Commission was last updated in 2012. This updated MOA includes new language of “Part III, F-Termination of Local Program” that outlines the process of terminating your program’s jurisdiction either in whole or in a select area (such as a County program who covers a Town and no longer wishes or is able to do so) to set out a process and timeframes that should be met for various steps to ensure a smooth transition. Other updates include aligning with the language of the current General Statutes.
