BACKGROUND
George Poston Park is a Gaston County owned and maintained park containing walking, mountain, and biking trails, athletic fields, a fishing pier, playgrounds, a pump track and picnic shelters. The addition of the lake was completed in 2010 which includes a dam and emergency spillway. Over the last 14 years, settlement has occurred within the emergency spillway resulting in settling, shifting, and rotating of the concrete emergency spillway wingwalls. The lake at George Poston Park is one of the many opportunities for citizens of Gaston County to enjoy outdoor recreation. If the emergency spillway structure were not fixed and the condition of the wingwalls continues to deteriorate, there is a possibility the lake would have to be drained, eliminating one of the main attractions of this park.
North Carolina General Statute (NCGS) ?143-64.31 requires the initial solicitation and evaluation of firms to perform architectural, engineering, surveying, construction management-at-risk services, and design-build services (collectively "design services") to be based on qualifications and without regard to fee. NCGS ?143-64.32 authorizes units of local government to exempt contracts for design services from the qualifications-based selection requirements of NCGS ?143-64.31 if the estimated fee is less than $50,000. However, the design fees for this project will exceed the $50,000 cap for exemption, thereby requiring the engineer to be selected through the qualifications-based process.
