BACKGROUND

The Comprehensive Control Act of 1984 and the Anti-Drug Act of 1986 provide for distribution among participating law enforcement agencies of assets forfeited in connection with drug related arrests. The above laws prohibit the use of such funds to reduce local funds budgeted for law enforcement programs. The North Carolina statute 143-129.7 dictates the procedure for purchasing with trade-in property.

The Gaston County Police Department requests $80,000 be appropriated for the purchasing of new hand guns for department use.  Currently, our officers are carrying the H&K 45 that is not a common law enforcement weapon.  Our vendor has discontinued the level III holster that houses this weapon and the department has not been able to find another vendor or manufacturer that sells the level III holster for this weapon.  Our present firearms will be traded for credit toward the purchasing of the new.  Funds to be allocated from the Drug Asset Fund Balance (#025-99-9900-0000-490000 - FY2016/$80,000).
