BACKGROUND

Gaston County currently owns PID 121088 (.09 acres) located on West Carolina Avenue (no assigned address) in Bessemer City. On April 26, 2001, Gaston County Board of Commissioners approved Resolution 2001-129 to declare this non-essential County-owned property as surplus and authorized staff to initiate sale procedures pursuant to North Carolina G.S. § 160A-270 (Public Auction). The parcel is vacant land not planned to be used by the County for future use.

 

The Gaston County Public Works office has received an offer to purchase said property for $1,200.00. Approval of the Board Action formally proposes to accept said offer subject to the conclusion of the upset bid process as required by statute and authorizes staff to conduct the upset bid process.

 

Under North Carolina G.S. § 160A-269, a County has the authority to “receive, solicit, or negotiate an offer to purchase property and advertise it for upset bids”. Per the statute, if the Board of Commissioners proposes to accept an offer for said property, the County must then advertise the bid in the newspaper and allow ten (10) days for a higher bid to be received.  If a higher bid is received, that bid is then advertised as before and the process continues to repeat until no higher bid is timely received. Staff will bring the highest and best offer back to the Board of Commissioners for final acceptance and approval.
